These terms apply when you use Clip Viral at aiclipviral.com (“Clip Viral”, “we”, “us”), a service based in New Zealand. By creating an account or using the service, you agree to them. If you do not agree, please do not use Clip Viral.
The service
Clip Viral uses artificial intelligence and third-party services to research topics, write scripts, create voiceovers, captions and visuals, and produce short-form videos, including on a schedule you set up, and, if you ask, post them to your own Facebook Page and Instagram account. We may improve, change or stop features over time.
Your account
- You must be at least 16 years old to use Clip Viral.
- Keep your sign-in details secure. You are responsible for activity on your account.
- Give accurate information, and tell us if you think someone else has accessed your account.
AI-generated content
Videos are created with AI. AI can make mistakes, including stating things that are wrong or out of date. Review every video before you publish it. You are responsible for what you publish, where you publish it, and for following the rules of the platforms you publish on, including any requirement to label AI-generated content.
Posting to Facebook and Instagram for you
If you connect a Facebook Page and turn on automatic posting, Clip Viral posts the videos you choose there, and on the Instagram account linked to it, at the times you choose, without asking you again each time. That means there is no review step before they go out, so only turn it on for a series or clips you are happy to be posted unseen. You are responsible for what you choose to post, just as if you had posted it yourself, and Facebook’s and Instagram’s own terms and rules apply to it. You can stop at any time: turn it off for a series, stop a clipping job’s posts, or disconnect in Settings. We can’t promise a post goes out at an exact time, or at all, if Facebook or Instagram refuses it or is unavailable.
Posting to YouTube for you
If you connect a YouTube channel and choose to post there, Clip Viral uploads the videos you choose, or that you set to post automatically, with their titles, descriptions and tags, and without asking you again each time. You are responsible for what you choose to post, as if you had uploaded it yourself, and the YouTube Terms of Service and YouTube’s Community Guidelines apply to it. YouTube limits how many videos an app may upload in a day, and may keep an upload private, so we can’t promise a video goes out at an exact time, or becomes public. You can stop at any time: turn it off for a series or in Social accounts, or disconnect the channel.
Acceptable use
You must not use Clip Viral to create or share content that:
- is unlawful, defamatory, harassing, hateful or threatening;
- sexualises minors, or is sexually explicit;
- impersonates a real person or organisation, or is meant to deceive people;
- infringes anyone’s copyright, trademark, privacy or other rights;
- is spam, or is designed to manipulate a platform’s systems.
You must also not try to break, overload or gain unauthorised access to the service, or resell it without our permission.
Your content
As between you and us, you own the topics and instructions you provide and the videos made for you, to the extent the law allows. You give us permission to store and process them only as needed to provide the service to you. Stock footage, music and other third-party material included in videos remain subject to the licences of their providers.
Videos you bring to Clip Viral
Some tools, such as AI clipping, work on a video you provide by upload, file link or a link to a video on another platform such as YouTube. When you provide a video, you confirm that:
- you own it, or you have the permission of everyone who owns rights in it to have it edited and republished;
- using it this way does not break the law or the rules of the platform it came from; and
- you are responsible for what you publish from it.
We may refuse or remove a video, or close an account, if we reasonably believe these promises are not true. We keep uploaded videos only as long as needed to provide the service, and you can delete them at any time.
Copyright complaints
If you believe something made with Clip Viral uses your work without permission, email support@aiclipviral.com with: your name and contact details, the work you own, where the content appears (links help), and a statement that you believe in good faith that the use is not authorised. We will look into it promptly, remove content that infringes, and close the accounts of people who repeatedly infringe.
Credits, plans and payments
Clip Viral runs on credits. A credit is worth one US cent at top-up prices, and each feature shows the credits it uses before you start. Nothing is charged for a generation that fails. Credits have no cash value and cannot be transferred.
- Free credits. Accounts with a verified email address (signed in with Google or Apple) receive 300 free credits once.
- Plans. Starter, Creator and Pro include credits every month. Premium includes 4 AI Video Editor videos a month and no credits, and on its own it opens the AI Video Editor only. Plans renew every month until you cancel.
- Unused credits. Plan credits reset at the end of each monthly billing period. Top-up credits expire 12 months after purchase. Unused Premium videos can be used until the end of the following month.
- Changing or cancelling. Upgrades apply straight away, and you pay the difference for the rest of the month. Downgrades apply at your next renewal. You can cancel at any time from Credits & billing, and your plan keeps working until the end of the month you have paid for.
- Prices and payment. Prices are in US dollars and include any GST we are required to charge. Your bank may add currency conversion fees. Payments are processed by Stripe; we never see your full card number. We will tell you at least 30 days before a price change applies to your plan.
- Refunds. Credits already used and plan months already started are not refunded, except where the law requires it or we made a billing mistake.
Suspension and closing your account
You can stop using Clip Viral and ask us to close your account at any time. We may suspend or close an account that breaks these terms or puts the service or other people at risk.
Our responsibility to you
We work to keep Clip Viral available and working well, but we provide it “as is” and cannot promise it will always be available, error-free, or produce any particular result, such as views, followers or income. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits rights you have that cannot be excluded by law, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. If you use Clip Viral for the purposes of a business, you agree that the Consumer Guarantees Act does not apply, to the extent the law allows.
Changes to these terms
We may update these terms. We will change the date at the top of this page, and for significant changes we will let account holders know by email. Continuing to use Clip Viral after a change means you accept it.
Governing law
These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction.
